Terms of Service

1. Acceptance of Terms

By accessing or using the ARKHE Software platform ("Service"), operated by ARKHE Software ("Company," "we," "us," or "our"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Service. The Service is designed for use by recovery housing operators, their staff, and residents in connection with the management of sober living and recovery housing programs.

2. Description of Service

ARKHE Software is a cloud-based recovery housing management platform that provides tools for resident intake and lifecycle management, billing and payment processing, compliance tracking and form management, communication between staff and residents, operational tools including chore assignments, maintenance tracking, and sign-in/out boards, and reporting and analytics. The Service is provided "as-is" and is intended as an operational tool — it does not provide medical, clinical, legal, or therapeutic advice.

3. Account Registration and Security

To use the Service, you must create an account with accurate and complete information. You are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account. You must notify us immediately of any unauthorized use or security breach. Organization owners are responsible for managing user roles and permissions within their organization.

4. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose or in violation of any applicable regulations
• Upload false, misleading, or fraudulent information
• Attempt to gain unauthorized access to other users' accounts or data
• Interfere with or disrupt the integrity or performance of the Service
• Use the Service to store or transmit content that violates the privacy rights of any individual
• Reverse engineer, decompile, or attempt to extract the source code of the Service

5. Data Ownership and Responsibility

You retain ownership of all data you enter into the Service ("Your Data"). We do not claim ownership of Your Data. You are solely responsible for the accuracy, quality, and legality of Your Data and for ensuring you have the right to input such data, including obtaining any necessary consents from residents. Organization owners may export their data at any time through the platform's data export features.

6. Sensitive and Health-Related Information

The Service may be used to store sensitive information, including drug screening results, medical intake information, and behavioral records. While we implement industry-standard security measures to protect this data, you acknowledge that the Service is not a HIPAA-covered entity. If you are a covered entity under HIPAA, you are responsible for ensuring your use of the Service complies with applicable regulations. You should not store Protected Health Information (PHI) in the Service unless you have evaluated and accepted the associated risks.

7. Payment Terms

Certain features of the Service may require payment. All fees are stated in U.S. dollars and are non-refundable unless otherwise specified. We reserve the right to change pricing with 30 days' advance notice. Payment processing is handled by Stripe, and you agree to Stripe's terms of service when making payments through the platform.

8. Service Availability and Modifications

We strive to maintain high availability but do not guarantee uninterrupted access to the Service. We may modify, suspend, or discontinue any part of the Service at any time with reasonable notice. We are not liable for any modification, suspension, or discontinuance of the Service.

9. Limitation of Liability

To the maximum extent permitted by law, the Company shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of data, revenue, or profits, arising out of or related to your use of the Service. Our total liability for any claim arising from or relating to the Service shall not exceed the amount you paid for the Service in the twelve (12) months preceding the claim.

10. Indemnification

You agree to indemnify and hold harmless the Company, its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorney fees) arising from your use of the Service, your violation of these Terms, or your violation of any rights of a third party.

11. Termination

Either party may terminate this agreement at any time. Upon termination, your right to access the Service will cease immediately. We will retain Your Data for 30 days following termination, during which time you may request an export. After 30 days, we may delete Your Data in accordance with our data retention policies.

12. Governing Law

These Terms are governed by and construed in accordance with the laws of the state in which ARKHE Software, LLC is incorporated, without regard to conflict of law principles. Any disputes arising from these Terms shall be resolved in the applicable state or federal courts.

13. Changes to These Terms

We reserve the right to update these Terms at any time. We will notify users of material changes by posting the updated Terms on this page and updating the "Last updated" date. Your continued use of the Service after such changes constitutes acceptance of the new Terms.
